France Népal Voyage takes the protection of personal data very seriously. France Népal Voyage pays close attention to the respect of the provisions relating to the protection of personal data, and more particularly to the provisions of the amended law of 6 January 1978 known as “Informatique et Libertés”, the General Data Protection Regulation 2016/679 (“RGPD“) as well as the recommendations issued by the CNIL (hereinafter the “Legislation in force”).

 

1. About this privacy policy

As the party responsible for the processing of your personal data, France Nepal Voyage wishes by this privacy and cookies policy (“Privacy Policy“) to explain how we may collect, use and process personal data (“Personal Data“) transmitted during the use by users of the website(s) (the “Website“) or our services (our “Services“) by our customers or prospects.

We may collect your Personal Data directly from you:

  • when you create a request via a form on the website or when you book a trip with France Népal Voyage ;
    when you communicate with our customer service department by email, during our telephone calls together or during in-branch meetings with our advisors.

We may also collect information from your profile on a third party social network (such as Facebook) if you allow the third party social network to share this information with us or if you post this information publicly. This information may include your general account information (e.g. name, email address, profile picture, gender, date of birth, current city, username, list of friends, etc.) and any other information or activity that you allow the third party social network to share with us or that you post publicly on your profile. 3. What personal data do we collect?

Personal Data is any information about a person from which that person can be directly or indirectly identified.

The Personal Data we collect from users of the Site or from customers or prospects using our Services is as follows:

  • your surname(s) and first name(s),
  • your date of birth
  • your gender
  • your postal address
  • your e-mail address,
  • your telephone number(s),
  • a copy of your identity document, only if you ask us to book your flights,
  • your booking history,
  • where applicable, special category data such as health data (disability, allergy or special conditions) or data that may indirectly enable us to obtain information concerning the religion, beliefs or personal convictions of the persons concerned (e.g. diet),
  • any other information that you may provide when using the Site or our Services.

We may also collect Personal Data from third parties. When you use our Services, you have the possibility of providing the contact details of one or more other persons (other participants in the trip, persons to be contacted in the event of an emergency, or persons who have participated in a gift list) or for other events (for example, for a wedding or a birthday). Therefore, you guarantee France Népal Voyage that the other persons whose data you communicate are informed of this transmission and accept it.

 

4. Why do we collect personal data?

The processing carried out and the legal bases for which we collect your Personal Data are as follows:

5. Who will receive your personal data?

We may share your Personal Data with the following third parties in compliance with the applicable Legislation:

  • with our affiliated entities in order to provide you with the requested Services
  • with our commercial partners, in particular suppliers of booked services (hoteliers, transporters, activities, excursions, etc.) or technical service providers (IT, hosting, email distribution, online payment service providers, etc.). We take particular care to ensure that these third parties offer sufficient guarantees to ensure the protection and security of your Personal Data
  • duly authorised French or foreign authorities (e.g. the tax authorities or the CNIL), in particular in the context of legal proceedings or a request for the provision of information

 

 

6. Security of Personal Data

As the party responsible for processing your Personal Data, France Népal Voyage implements all the technical and organisational measures necessary to respect the protection of your Personal Data and takes care to limit the amount of data processed in relation to the finalities pursued. We have procedures in place to deal with any suspected breach of data security and will notify you and any relevant supervisory authority of a suspected breach where we are legally required to do so.

However, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you believe that the security of an account you have with us has been compromised), please notify us immediately by contacting us using the details above.

 

7. Data processing outside the European Union

We may transfer your Personal Data to countries outside the European Economic Area (“EEA”) solely for the purposes described in this Privacy Policy.
Where Personal Data is transferred outside the EEA, we will take appropriate steps to ensure that the recipient adequately protects your Personal Data in accordance with this Privacy Policy. These measures may include the following:

  • (b) ensuring that there is an adequacy decision from the European Commission in the event of a transfer outside the EEA, which means that the recipient country is deemed to provide adequate protection for such Personal Data

8. How long do we keep your Personal Data?

We will only keep your Personal Data for as long as is necessary for the purposes for which it was collected, including to meet any legal or accounting requirements.

In determining the appropriate retention period for Personal Data, we take into account the amount, nature and sensitivity of the Personal Data, the potential risk of harm arising from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and the possibility of achieving those purposes by other means, as well as applicable legal requirements.

We retain the following information for the periods indicated below:

  • For prospective customers, newsletter subscribers or those who have requested a quotation but have not yet received one:
    Maximum retention period: 3 years from the date of last contact between the prospect and France Népal Voyage.
  • For clients,
    Maximum retention period :
    • 10 years from the date of last contact between the client and France Népal Voyage
    • 10 years after return from travel for copies of identity documents
    • 10 years for travel contracts, registration forms and invoices (legal obligation)
    • 10 years after the return of the trip in case of physical injury related to the trip (legal obligation)
    • In the event of legal proceedings, until the proceedings have been completed.

After these deadlines, the data is either deleted or kept after being anonymised, in particular for statistical purposes. They may be kept for pre-litigation and litigation purposes. It is reminded that deletion or anonymization are irreversible operations and that France Népal Voyage is no longer able to restore them.

 

 

9. Rights of data subjects

As a Data Subject, you have various rights. These rights are not absolute and each of these rights is subject to certain conditions in accordance with the GDPR and applicable national laws.

  • The right of access – you have the right to obtain from us confirmation as to whether or not your Personal Data is being processed by us, as well as certain other information (similar to that provided in this Privacy Policy) about how it is being used. You also have the right to access your Personal Data, by requesting a copy of your Personal Data. This allows you to know and verify that we are using your information in accordance with data protection laws. The Website may contain links to other websites operated by third parties. Please note that this Privacy Policy applies only to Personal Information collected by France Népal Voyage. We are not responsible for Personal Information that third parties may collect, store and use on their own websites or applications. Moreover, France Népal Voyage is not responsible for hypertext links leading to the Website, that third party websites and/or applications could integrate even if France Népal Voyage would have authorised the third party editor of the said third party website and/or application to place such a link.
